Commenting on a proposed Medicare payment rule: what agency staff actually read

A comment changes a final rule when it gives the agency data it does not have.

Agencies must consider the comments they receive on a proposed rule. The ones that change the final rule give staff something new: data, a cost, a consequence they missed.

What works

  • Cite the section of the proposed rule you are commenting on
  • Give numbers from your own operations
  • Propose specific language

Comments filed on regulations.gov are public, so leave out anything you would not want a competitor to read.
